SHW instructed to complete a terminal schedule of dilapidations on behalf of the landlord

SHW’s Building Consultancy Department were appointed by the landlord to prepare a terminal Schedule of Dilapidations for an office building located in East Sussex, following the tenant exercising the break clause included within the lease.



The tenant’s surveyor tried to reduce the claim and dispute that numerous installations installed by the tenant improved the marketability of the property.  However, we managed to successfully demonstrate that various installations were redundant and costs for removal were included within the agreed full and final settlement figure.  In addition, we successfully demonstrated items which were at the end of their serviceable life and should have been replaced by the tenant during the term. 

 

SHW successfully managed to negotiate a commercial cash settlement of the claim which totalled £2,300,00.00. The settlement also included removal of the tenant’s extensive fitout. The settlement rate totalled £34.32 ft2.

 

The total timeframe from instruction to settlement of the claim totalled 5 months. Furthermore, we managed to settle the claim prior to the break date, which assisted with the landlord’s business planning and refurbishment strategy, which is now awaiting instruction to proceed to RIBA Stage 2.
